Bombay HC Gives Go Ahead To BKC Metro Station For Cutting Mangroves

On June 13, 2017, Bombay High Court division bench of justices MS Sonak and VM Kanade permitted Mumbai Metro Rail Corporation Ltd (MMRCL) application to allow them to cut 108 mangroves in suburban Bandra-Kurla Complex so they can continue constructing the station on the Metro III line. The HC under a previous hearing of a public interest litigation filed by Bombay Environmental Action Group had mandated that any action regarding mangroves will need its permission. Thus the necessary procedure was followed by the Mumbai Metro Rail Corporation Ltd.

The Mumbai Metro Rail Corporation Ltd assured that all the required permissions from the concerned authorities were in place and mature mangroves trees will be planted by them in the area once the project work is completed. They also mentioned that they will look after the mangroves tree for a period of three years after planting. The court accepted this undertaking. Justice Kanade said, “Ensure that you (MMRCL) have all the necessary permissions. Also, make sure that the trees are planted properly. The method has to be proper, or else the trees will die and there will no point of this undertaking.”

Pointing further Justice Kanade said, “At the planning stage itself you (MMRCL) should have been careful and seen to it that no mangroves need to be cut.” MMRCL advocate Kiran Bagalia said they had to move ahead with this land at BKC as the alternative land in Kurla was under litigation.

An estimated 5,000 trees may have to be cut in several areas in south Mumbai in order to finish the Colaba-Bandra-SEEPZ Metro line III project. The 33-km line III project will connect Cuffe Parade to SEEPZ in the city’s north-central suburb as part of the metro system.
